"Agreement" refers to this Agreement, including an understanding and acceptance of this and all of the following articles as listed within this document.

"Confirmation" refers to the acceptance of the agreement between the Chatter and Fate's Labyrinth Chat, which may be enforced from the time of acceptance of this agreement.

"Fate's Labyrinth Chat" refers the hosting service for the chatting system. Which includes but is not limited to, chatting, posting on message board, the hosting pages, images and/or galleries on it's severs.

"Fate's Labyrinth Website" refers to http://fateslabyrinth.net

"User" refers to a visitor or member. 

You are only authorized to use the services of Fate's Labyrinth or its website fateslabyrinth.net if you agree to abide by all applicable laws and the terms of this Agreement, regardless of whether your access or use is intended.)

If you do not agree to be bound by this Agreement and to follow all applicable laws, you should leave the fateslabyrinth.net website and discontinue use of the Fate's Labyrinth Chat Services immediately.  If you wish to become a member, communicate with other members and/or make use of Fate's Labyrinth Chat Services you must read this Agreement and indicate your acceptance during the registration process.

1. Fate's Labyrinth Chat, while being itself under the jurisdiction of United States law, strives to not only enforce laws which apply directly under it, but maintains a strict code of conduct to which all chatters, hosts, and members of staff are bound. Failure to comply with any and all of the following points may result in immediate and irrevocable banning from Fate's Labyrinth Chat, which is dependent on the severity of the infraction itself.

2. The practice, discussion and/or advocation of illegal activities is prohibited on Fate's Labyrinth Chat. This includes, but is not limited to, any and all computer crimes/vandalism related to computer crimes that fall under United States law.  Fate's Labyrinth Chat reserves the right to investigate and take appropriate legal action against anyone who, in Fate's Labyrinth Chat's sole discretion, violates this provision, including, without limitation removing the offending Content and terminating the membership of such violators. Prohibited content includes, but is not limited to content that, at the sole discretion of Fate's Labyrinth Chat Services:

          a. The proliferation or discussion of child pornography and transmittance of any and all pornographic materials to minors;

b. The creation of material involving scenes that would be considered pedophilic in nature, by United States law, will not be tolerated. This includes and but is not limited to content that::

1. links to pornographic, pedophilic or illegal websites;

2. solicits personal information from anyone under 18 years of age;

3. any content or scene which would portray a character below the age of consent in sexual relations with another character with the possible exclusion of situations where the general story would be about a time when such activity at the portrayed age would be considered, legal, acceptable, and normal.  (i.e., permitted material: A 14 year old character getting married at a time when it was not unusual for 14 year olds to be given in marriage. Material that would not be permitted: A 14 year old character suffering the incestuous advances of a parent.)

c. The posting of content which;

1. promotes racism, bigotry, hatred or physical harm against a group or individual;

2. harasses or advocates the harassment of another person;
   i.  logging into Fate's Labyrinth with the sole intent of taking names from the Who's On list to distribute to others with the knowledge that this distribution will
       result in harassment of that individual via email or by causing them to be banned from other sites constitutes legal harassment and will be reported to authorities.
   ii. Copying and pasting conversations from Fate's Labyrinth to be distributed via email or to other sites, without the express permission of the owners of Fate's Labyrinth, or with the express permission of the parties involved constitutes illegal behavior.
   iii. management reserves the right to share information related to violations 2i and 2ii with our server hosts, legal authorities, and any parties management deems to be threatened or damaged by such behavior.

3. is patently offensive in nature.

4. publicly posts information that poses or creates a privacy or security risk to any person;

3. The circumvention of bans, through the creation of additional accounts or by violation of terms outlined in Article II (CONDUCT) second paragraph, will result in the permanent, immediate and unconditional banning from Fate's Labyrinth Chat. The chatter will also accept that these procedures come without the benefit of appeal. 

4. While Fate's Labyrinth Chat prides itself on the privacy of it's players, the impersonation of the staff, administrators, supervisors or any other chatter will not be tolerated. This of course includes the creation of a handle in order to seed confusion or conflict, or the alteration of said handles in order to lead others to believe the chatter is someone else.

5. The use of bots, spiders and/or other electronic means to collect other chatters personal information will will result in the immediate termination of the account and subsequently denying all associated address spaces from which those processes originated from.

6. Fate's Labyrinth Chat Services assumes no responsibility for monitoring Fate's Labyrinth Chat Services for inappropriate Content or conduct.  If, at any time, Fate's Labyrinth Chat Services chooses, in its sole discretion, to monitor the Fate's Labyrinth Chat Services, Fate's Labyrinth still assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the user submitting any such Content.  However, Fate's Labyrinth Chat Services reserves the right to remove any content or member from the site at the will of Fate's Labyrinth Chat without warning or obligation to notify.

7. You agree that you are solely responsible for the Content that you post on or through any of the Fate's Labyrinth Chat Services, and any material or information that you transmit to other Members and for your interactions with other Users,

1. Information provided during the registration process or during the course of the chatters stay on Fate's Labyrinth Chat will not be released, or sold in any way, shape, or form. This includes, but it not limited to, selling the information for reasons of profit; Giving out the information to sister sites to encourage a migration and intermixing of players; Referring to confidential information in publicly accessible documents or realms. Fate's Labyrinth Chat also agrees to not enter into any contract that will force the release of confidential information that is user specific.

2. The chatter agrees that the information provided is valid (including, but not limited to, a valid email address), allowing the Realms to contact the chatter if the need arises. This can be for reasons ranging from notice of system failure, planned changes regarding the system, or change of ownership. The chatter also agrees to keep said information valid and up to date with the risk of losing their account if the information is proved false.

3. Furthermore any and all accounts/posts/users activities will be logged, monitored and stored into a database and/or a series of log files. While the information is confidential and will not be distributed as per the prior agreement by Fate's Labyrinth Chat, the chatter is hereby informed that such a practice is taking place. The chatter also agrees that Fate's Labyrinth Chat itself can reference this information for the purpose of statistics building, mediation of conflict or any other reason so long as it does not violate the privacy agreement.

4. Fate's Labyrinth Chat will cooperate fully with all law enforcement agencies investigating any suspected illegal activities.

1. Fate's Labyrinth Chat agrees to allow a chatter the ability to expose literary and graphical works with donations meeting criteria as per the Article V (DONATIONS) paragraph 4.

2. The chatter agrees to the restriction regarding deriving direct profit from the use of these facilities. This includes, but is not limited to the hyper-linking of works to an existing gallery in which profits are generated from the sale of the specific works and/or merchandise. Nor the exposition of works which include image or text based ads.

3. The chatter agrees to be bound by United States copyright laws regarding stored works. This includes, but is not limited to, copyrighted written material, images which carry with them no permission to be used by the copyright owner. All original works by the chatter will automatically carry forth their copyright unless otherwise specified by said chatter.

4. The chatter also agrees that as a possible user of the gallery component, that Fate's Labyrinth Chat has the right to perform periodic audits and subsequent removal of material that is deemed offensive. If any material is found to violate valid copyright laws or is illegal in nature as per the terms defined in Article II (CONDUCT), the material may not only be removed but can result in subsequent warnings followed by a possible banning of said chatter.

5. Galleries which draw too many complaints as per the nature of the material involved, may also be removed pending an investigation by Fate's Labyrinth Chat. If the material is found to be offensive in any way, shape or form the material will be removed at once and the chatter informed.

6. The chatter will agree that any copyright disputes involving the chatter and a third party over copyright material will not be handled by Fate's Labyrinth Chat. The chatters are themselves responsible for the enforcement of their copyrights across the provided medium.

7.  Room hosts and moderators agree to monitor the rooms they serve to ensure compliance with law, and to notify Fate's Labyrinth Chat management of any possible violations of this agreement. 

8. Fate's Labyrinth Chat Services does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, applications, or any other content materials that you post on or through Fates Labyrinth Chat Services.  After posting such content to the Fate's Labyrinth Chat Services you continue to retain any such rights that you may have in your content, subject to limited license herein.  By displaying or publishing or posting any content on or through Fate's Labyrinth Chat Services, you hereby grant a limited license to Fate's Labyrinth to use, modify, delete from, add to, publicly perform, publicly display, reproduce, and distribute such Content solely on or through the Fate's Labyrinth Chat Services, including without limitation distributing part or all of the Fate's Labyrinth Website in any media formats and through any media channels, except content marked "private". Content marked private will not be distributed outside the Fate's Labyrinth Chat Website.

This limited license does not grant Fate's Labyrinth Chat Services the right to sell or otherwise distribute your content outside of the Fate's Labyrinth Chat Services.  After you remove your content from Fate's Labyrinth Chat Services we will cease distribution as soon as practical, and at such time the limited license will cease.

The license you grant to Fate's Labyrinth Chat Services is non-exclusive, fully-paid and royalty-free (meaning Fate's Labyrinth Chat Services is not required to pay you for the use on the the Fate's Labyrinth Chat Services of the content that you post, sublicensable, and worldwide.

9. The Fate's Labyrinth Chat Services contain content from Fate's Labyrinth Services. Such content, including any material related to Nia Goldenshield, Nia's Tavern, Crusadia, Alexander Goldenshield, Davikk, or Drassiniyan is portected by copyright, trademark, patent, trade secret and other laws.

10. Fate's Labyrinth Chat Services may reject, refuse to post any Content for any or no reason, including Content that in the sole judgement of Fate's Labyrinth Chat violates this agreement or which may be offensive, illegal or violate the rights of any person or entity, or harm or threaten the safety of any person or entity. 

1. Chatters agree that donations made come with no warranty as per Article VIII (WARRANTY) and that donations cannot be refunded at any time.

2. Chatters understand that donations made to Fate's Labyrinth Chat will go towards the upkeep or upgrades of the site. The chatter will also be aware that donations will not be tracked beyond their initial transaction, meaning that Fate's Labyrinth Chat will not account for every dollar spent.

3. In the case of donations done electronically using the existing infrastructure which meet the necessary criteria of a donation will allow users to reach contributor based features. This may also allow the chatter to reach previously unavailable content restricted to contributors. The chatter will be aware that having a 3rd party use the automated systems will lose ownership of their accounts.

4.  You acknowledge that Fate's Labyrinth reserves the right to charge for any portion of the Fate's Labyrinth Services and to change its fees (if any) at its discretion.  If Fate's Labyrinth Chat Services terminates your membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of fees or payments (if any).

1. Chatters will aid Fate's Labyrinth Chat in keeping updated contact information as per the agreement of Article III (PRIVACY).

2. Fate's Labyrinth Chat reserves the right to revoke your membership if it is discovered that a chatter has infringed this agreement in any manner. Fate's Labyrinth Chat will monitor any reported problems a chatter may have. If deemed necessary and shall contact the local authorities if the breached as defined in Article II (CONDUCT).

3.  When you register for membership you will be asked to select a password. You are entirely responsible for maintaining the confidentiality of your password.

4. You agree not to use the account, username or password of another Member at any time or to disclose your password to any third party.

5. You agree to notify Fate's Labyrinth Chat Services immediately if you suspect any unauthorized use of your account or access to your password.

6. You are soley responsible for any and all use of your account.

7. You represent and warrant that: (i) you own the Content posted by you or through the Fate's Labyrinth Chat Services or otherwise have the right to grant license set forth in section V.8 above. You agree to pay for all royalties, fees, and any other monies owing any person or entity by reason of any content posted by you on or through Fate's Labyrinth Chat Services.

1. The chatter is hereby warned that this document may be changed/adapted at any point in time by Fate's Labyrinth Chat. However, Fate's Labyrinth Chat vows that the spirit of the agreement will remain essentially static, and that only supplementary information or more complete definitions will be added in order to make the document more readable.

2. If the nature or spirit of the document itself is to change, Fate's Labyrinth Chat is to inform the chatters of this change using email as the chosen transport. The chatter is warned however, to verify for changes on a periodic intervals of time as to keep abreast with possible revisions.

3. This Agreement, and any posted revisions to this Agreement, shall remain in full force and effect while you use the Fate's Labyrinth Chat Services or are a Member.  You may terminate your membership at any time, for any reason.  Fate's Labyrinth Chat Services may terminate your membership at any time, for any or no reason, with or without prior notice or explanation, and without liability. Even after membership is terminated, this agreement will remain in effecting.

1. The chatter agrees that with the use of this service comes no warranty whatsoever as to availability, data integrity, security or quality of service. The service is provided free of charge and will continue solely at the discretion of the staff. The service is provided "as is" without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. This is also limited to upkeep of your account with a current e-mail so we may contact you as needed with regards to site business ie, down time of server, moving of links, and important information.
